1. General
These Terms and Conditions ("Terms") of Sapere.Coffee s.r.o., registered at Křížová 2598/4, Smíchov, 150 00 Praha 5, Czech Republic, Company ID: 217 32 442, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, File 405752 ("Seller"), govern the rights and obligations arising from purchase agreements concluded through the online store at apt.cafe ("Store") between the Seller and the Buyer.
These Terms apply to retail purchases by individual customers. For wholesale orders, separate terms apply — please contact us at jaromir@sapere.coffee.
2. Ordering and Contract Formation
All product listings on the Store are informational. A purchase agreement is formed when the Seller confirms the Buyer's order by email. The Seller reserves the right to request additional order confirmation depending on order size or value.
By placing an order, the Buyer confirms that all provided information is accurate and agrees to these Terms.
3. Prices and Payment
All prices displayed include VAT where applicable. EU-registered businesses may apply for VAT exemption using the VAT validation tool at checkout. Payment may be made by credit/debit card or other methods available at checkout.
4. Shipping and Delivery
Shipping costs and estimated delivery times are displayed at checkout. The Buyer is responsible for inspecting goods upon delivery and reporting any damage to the carrier immediately.
5. Right of Withdrawal
Consumers within the EU have the right to withdraw from a purchase agreement within 14 days of receiving the goods, without giving a reason, in accordance with applicable EU consumer protection law. This right does not apply to goods that are perishable, sealed for hygiene reasons and opened after delivery, or custom-made to order.
To exercise the right of withdrawal, contact us at jaromir@sapere.coffee. Goods must be returned within 14 days of withdrawal at the Buyer's expense. Refunds will be issued within 14 days using the same payment method.
6. Complaints and Defects
The Buyer should inspect goods promptly upon receipt. Any defects must be reported to the Seller without undue delay. The Seller is responsible for defects present at the time of delivery in accordance with applicable law.
7. Personal Data
Personal data is processed in accordance with our Privacy Policy and the GDPR (EU Regulation 2016/679).
8. Dispute Resolution
For out-of-court resolution of consumer disputes, the competent authority is the Czech Trade Inspection (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, https://adr.coi.cz/cs. The EU Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr.
9. Final Provisions
These Terms are governed by Czech law. If any provision is found invalid, the remaining provisions remain in full force. The Seller may amend these Terms; the updated version takes effect upon publication on the Store.
